The agreement
By creating an account you agree to these terms. If you are agreeing on behalf of a company, you confirm you are allowed to bind it. Vitonize is operated by [[LEGAL ENTITY NAME]], [[REGISTERED ADDRESS]], company number [[OIB / COMPANY NUMBER]].
What the service is
Vitonize produces photoreal imagery and video from the material you supply, using third-party AI engines. Output is generated, not photographed. It will sometimes be wrong, and it is your responsibility to review anything before you publish it.
Your account
- You must be at least 18, or old enough to enter a contract where you live.
- Keep your password to yourself. Anything done through your account is treated as done by you.
- One person or company per account. Tell us at once if you think someone else has access.
Credits, plans and payment
- Plans are billed monthly or annually in advance and renew automatically until cancelled.
- Credits are consumed per generation. The price of a generation depends on the engine, the resolution and, for video, the length — the studio shows the cost before you spend it.
- Monthly plan credits do not roll over into the next month. Top-up credits you buy separately do not expire while your account is open.
- Cancelling stops the next renewal. It does not refund the period you are in, and you keep access until it ends.
- Prices may change with 30 days' notice. The price of a period already paid for does not change.
Your right to cancel, and its limit
As a consumer in the EU you normally have 14 days to withdraw from a distance contract. Because credits are digital content supplied immediately, that right ends once you start generating: by making your first generation you ask us to begin at once and acknowledge you lose the withdrawal right for the credits used. Unused credits inside 14 days are refundable.
This paragraph does not apply if you are contracting as a business rather than as a consumer.
What you upload
You keep everything you owned before. You give us only the permission we need to run the service: to store your material and pass it to our AI providers so they can produce your result. That permission ends when you delete the material.
You promise that you have the right to upload what you upload — including permission from any identifiable person in a photograph, and the rights to any logo, garment or design shown.
What comes out, and who owns it
You may use your generated output commercially, on every paid plan, with no watermark and no per-use fee. Free-plan output is for evaluation only.
We do not claim ownership of your output and will not resell it. We may show work publicly only with your written permission.
What you may not do
The Acceptable Use Policy is part of these terms. Breaking it can cost you your account without refund.
Availability
We aim to keep the studio running but do not promise it never stops. We depend on third-party AI providers, and when one of them is down, that part of the studio is down. We give no uptime guarantee on any plan unless we have signed one with you separately.
Liability
Nothing here limits liability for death, personal injury, fraud, or anything else the law does not allow us to limit. Beyond that, our total liability to you in any 12-month period is limited to what you paid us in that period, and we are not liable for lost profit, lost business or lost data.
Ending it
You may close your account whenever you like. We may suspend or close an account that breaks these terms, that we are legally required to close, or that has not been paid for. If we close your account without cause, we refund the unused part of what you paid.
Law
Croatian law governs this agreement, and the courts of [[COURT / CITY]] have jurisdiction. If you are a consumer, you keep the protection of the mandatory law of the country you live in, and you may use the EU Online Dispute Resolution platform.
